01 Introduction
These Terms of Use ("Terms") govern your use of the Promus mobile application and all related services. The App is developed and operated by Kirill Kitov, trading as KitLab. By downloading or using the App, you agree to these Terms. If you do not agree, please stop using the App.
These Terms should be read together with the Promus Privacy Policy.
02 Age Requirements
You must be at least 13 years old to use the App. Users between the ages of 13 and 17 may only use the App with the consent and supervision of a parent or legal guardian.
03 Account
To access the App's features, you must create an account using one of the following methods:
- Google Sign-In — sign in via your Google account. By using this method, you also agree to Google's Terms of Service.
- Email — register with your email address and verify via a confirmation code. No password is required.
You are responsible for maintaining the security of your account access and for all actions performed under your account.
04 Description of Services
Promus provides the following audio processing features:
- Stem separation — vocals, drums, bass, guitar, piano, and other instruments.
- MIDI transcription
- BPM and key analysis
- Pitch and speed adjustment
- Audio import — from your device or via a link.
- Export — with format, bitrate, and output settings.
We reserve the right to modify or expand the App's functionality at any time.
05 User Content
You retain ownership of any content you upload. By uploading audio, you grant us a limited license to process it solely for the purpose of providing the App's services and delivering results to your device.
You confirm that you hold all necessary rights to the content you upload and are solely responsible for its legality.
06 Acceptable Use
You agree not to:
- Upload content to which you do not hold the rights.
- Use the App to infringe the intellectual property rights of third parties.
- Attempt to reverse engineer or otherwise tamper with the App.
- Use automated tools to abuse the service.
- Resell or commercially exploit processed results derived from content you do not own.
07 Cloud Processing
Cloud-based processing is a core function of Promus. By uploading audio through the App, you agree to its transmission to our servers and the servers of engaged cloud processing providers for AI processing. Uploaded files and results are temporarily stored in cloud storage. If you do not agree to this, please do not use the App.
08 Third-Party Services
To operate the App, we use the following third-party services:
- Google Sign-In — sign-in via Google account.
- Firebase — sending push notifications about processing status.
- Brevo — sending emails: confirmation codes at sign-in, and product update notifications (if you have opted in).
- Cloud processing providers — AI audio processing on remote servers.
- Cloud storage — temporary file storage during processing.
- Payment platforms — processing payments via the app store.
09 Minute Packages and Payment
New users receive 20 minutes free of charge to explore the App's features and processing quality.
To continue using the App, you must purchase a minute package. Available packages and pricing are displayed in the App. Minutes are deducted with each processing job based on the length of the track.
Payments are processed through Google Play. Each package purchase is a one-time transaction — no automatic charges occur.
Purchased minutes do not expire and are tied to your account.
Unused minutes may be refunded in accordance with Google Play's refund policy or applicable law.
10 Intellectual Property
All rights to the App, including its software, design, and technology, belong to Promus or its licensors. These Terms do not transfer any ownership rights in the App to you.
11 Disclaimer of Warranties
The App is provided "as is" and "as available." We do not guarantee uninterrupted operation or that processing results will meet your specific expectations.
12 Limitation of Liability
To the maximum extent permitted by applicable law, our total liability shall not exceed the amount you paid for your most recently purchased minute package.
13 Termination
We reserve the right to suspend or delete your account if you violate these Terms.
14 Changes to These Terms
We may update these Terms from time to time. The current version is always available in the App. Continued use of the App constitutes acceptance of the updated Terms.
